1. Acceptance of Terms
By downloading, accessing, or using the Health-MindTrack website and application (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform. These terms constitute a binding legal agreement between you and EDMC (Emergency Disaster Management Corporation).
2. Intellectual Property and Restrictions
The Platform, including its original content, features, functionality, and underlying data science algorithms, are owned by EDMC (Emergency Disaster Management Corporation) and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Strict prohibitions: you explicitly agree not to:
- Copy, modify, or create derivative works of the Platform or any portion thereof.
- Reverse engineer, decompile, or disassemble the Platform's source code or underlying architecture.
- Scrape, mine, or extract data from the Platform for the purpose of replicating its services or building a competing product.
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices embedded within the Platform.
3. User Accounts and Responsibilities
To access certain features of Health-MindTrack, you may be required to register an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. EDMC (Emergency Disaster Management Corporation) reserves the right to terminate accounts that violate these Terms or pose a security risk.
You must be at least 16 years old, or the age of digital consent in your country if that age is higher.
You may delete your account in Privacy Centre in the app or on the website. Deletion removes your account and saved wellness data, except records we must keep for security, legal, or accounting reasons.
4. Wellness tool — not a medical device
Health-MindTrack is a wellness tool, not a medical device. Measurements are for personal insight only. The Platform does not diagnose, treat, cure, or prevent any disease, and it is not a substitute for a clinician or in-person care.
Do not use the Platform for emergencies. If you think you are having a medical emergency, call local emergency services.
Features on your phone may measure optical pulse, heart sound, voice, and optional breath recordings. The website shows history and context.
5. Disclaimer of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
In no event shall EDMC (Emergency Disaster Management Corporation), its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Alberta, Canada.
8. Changes to these Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated documents on the Platform. Your continued use of the Platform after changes have been posted constitutes your acceptance of the revised terms.
Breath Sound Clarity
Breath Sound Clarity is an experimental research feature. It collects acoustic features from a short breath recording on your phone to train our own descriptive models. It is not a diagnostic instrument, not a medical diagnosis, and not meant to assess your breathing. Do not use it if you have breathing complaints — get in-person care instead.
I understand this collects data for future model training, not a health scan or medical diagnosis.
